OVERVIEW

This Privacy Policy governs the manner in which KenyaBuzz Ltd (“we”, “us”, “our”) collects, uses, maintains and discloses information collected from users (each, a “User”) of the https://kenyabuzz.com website (“Site”). This privacy policy applies to the Site and all products and services offered by us. The use of information processed through our services shall be limited to the purpose of providing the services for which our customers have engaged us.

SECTION 1 - PERSONAL INFORMATION

We may collect personal information from Users in a variety of ways, including, but not limited to, when Users visit our Site, make a ticket purchase on the Site, and in connection with other activities, services, features or resources we make available on our Site. Users may be asked for personal data, as appropriate, which will include Users’ name, email address and phone number. We will collect personal information from Users only if they consent voluntarily to submit such information to us. Users can always refuse to supply personal information or withdraw their consent for us to process that information at any time, except that it may prevent them from engaging in certain Site related activities. Users may access certain areas of our Site without providing any personal data at all. However, to use all features and functions available on our Site, Users may be required to submit or allow for the collection of certain data.

Users have the right to withdraw their consent to us using their personal data at any time, and to request that we delete it.

  • rectification if any personal data we hold about them is inaccurate or incomplete;
  • be forgotten (meaning the right to ask us to delete any personal data we hold about them). We only hold personal data for a limited time, as explained in this privacy policy but if a User would like us to delete it sooner, they should contact us using the details in this privacy policy;
  • restrict (i.e. prevent) the processing of your personal data;
  • data portability (obtaining a copy of their personal data to re-use with another service or organisation);
  • object to us using their personal data for particular purposes; and
  • rights with respect to automated decision making and profiling.

SECTION 2 - PASSIVE INFORMATION

As is true of most websites, we gather certain information automatically. This information may include Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, the files viewed on our Site (e.g., HTML pages, graphics, etc.), operating system, date/time stamp, and/or clickstream data to analyze trends in the aggregate and administer the Site. If combined with other information we know about Users from previous visits to our Site, the data possibly could be used to identify them personally, even if such Users are not signed in to our Site.

SECTION 3 - How we use collected information

We may collect and use Users’ personal information for the following purposes:

  • Information Users provide helps us respond to their customer service requests and support needs more efficiently.

  • To send marketing materials to the customer from KenyaBuzz, the Nation and occasionally from third parties
  • We may use the information Users provide about themselves when placing an order to provide service to that order. We do not share this information with outside parties except to the extent necessary to provide the service.

SECTION 4 - How we protect User information

The security of both our customers’ data and any 3rd party data we process on their behalf is very important to us. All personal data will be processed and stored by us safely and securely for no longer than is necessary in light of the reason for which it was first collected by us. We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of Users personal information, username, password, transaction information and data stored on our Site. We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once it is received. SECTION 5 - Sharing User personal information

We will share Users’ personal information with third parties only in the ways that are described in this privacy policy. We do not sell, trade, or rent Users personal information to others. We may provide Users’ personal information to companies that provide services to help us with our business activities such as offering customer service and payment processing. These companies are authorized by us to use Users’ personal information only as necessary to provide these services to us and we will take all reasonable steps to ensure that User personal data will be handled safely, securely, and in accordance with their rights, our obligations, and the obligations of the third party under relevant data protection law. Transfers to subsequent third parties are covered by the provisions in this privacy policy regarding notice and choice and the service agreements with our Users. We may share generic aggregated demographic information not linked to any personal information regarding visitors and Users with our business partners, trusted affiliates and advertisers for the purposes outlined above.




Your legal rights

Under certain circumstances, you have rights under data protection laws in relation to your personal data. If you wish to exercise any of the rights set out below, please contact us. You have the right to:

Request access to your personal data (commonly known as a “data subject access request”). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios:
(a) if you want us to establish the data’s accuracy;
(b) where our use of the data is unlawful but you do not want us to erase it;
(c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or
(d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw 10 your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

No fee usually required You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

What we may need from you We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
